The Equality Act 2010 makes it clear that buildings must be designed and managed in a way that does not hinder disabled people. In an emergency, ineffective fire detection and emergency lighting can place people with mobility, sensory or cognitive impairments at heightened risk. For electrical contractors, the responsibility is not only to install life safety systems that meet specifications but also to help building owners understand their duties.
Compliance procedure
Ensuring fire detection and emergency lighting systems comply not only with standards such as BS 5266, BS 5839, the Regulatory Reform (Fire Safety) Order 2005 and Part M of the Building Regulations, is essential for meeting the requirements of the Equality Act 2010. Compliance ensures the safety of all building users, including those with disabilities.
The Equality Act 2010 requires ‘reasonable adjustments’ to be made so that people with disabilities are not placed at a disadvantage, while Part M of the Building Regulations focuses on access and facilities for disabled people, including safe evacuation during emergencies. As such, electrical contractors should ensure that emergency lighting is integrated with accessible escape routes and that fire detection systems can be easily understood and used by all occupants.
The Regulatory Reform (Fire Safety) Order 2005 assigns responsibility to a designated ‘responsible person’ within an organisation to conduct risk assessments aimed at identifying, managing and mitigating fire hazards. While electrical contractors are not usually the responsible person, their work directly ties into fire safety obligations. For example, the responsible person may rely on electrical contractors to provide inspection reports, such as Electrical Installation Condition Reports (EICRs), which feed into a fire risk assessment.
Above and beyond
BS 5266 provides detailed guidance on emergency lighting systems, including illumination levels, escape routes and maintenance procedures. However, electrical contractors must often go beyond minimum technical standards, for example, emergency lighting should be positioned to avoid glare and ensure clear visibility of exit routes for wheelchair users and those with poor vision.
Likewise, while BS 5266 may require one lux along escape routes, the Equality Act 2010 may necessitate higher levels of uniformity or additional lighting in areas where people with impaired vision might struggle to navigate. The use of signage must also be considered in relation to both lighting performance and legibility for those with visual or cognitive impairments.
When it comes to fire detection and alarm systems, BS 5839 provides guidance on design, installation, commissioning and maintenance. Audible alarms may meet the technical requirements of BS 5839, but they may not be adequate for people who are deaf or hard of hearing. To meet the obligations of the Equality Act 2010, contractors should consider the installation of visual beacons or vibrating pillow devices in sleeping areas.
First things first
Compliance should be considered a process that begins at the design stage and continues through installation, commissioning and maintenance. When designing, it is essential to carry out a risk assessment that looks not only at the fire risks in the building but also at the likely profile of its occupants. For instance, in a multi-occupancy building, diverse user profiles might include elderly residents, children or staff with sensory impairments – all of which will have unique needs.
The Equality Act 2010 demands that accessibility challenges are factored into the design of life safety systems. As well as the aforementioned considerations, this might also mean specifying wider beam angle luminaires for emergency lighting, ensuring that call points are positioned at accessible heights or integrating voice alarm systems that provide clear spoken instructions rather than relying solely on tones.
Installation itself must also be handled with a view to equality and safety. Poorly placed luminaires may technically satisfy BS 5266 but leave staircases in partial shadow, creating additional hazards for those with reduced mobility or sight. Similarly, the placement of visual alarms must avoid glare and be located where they can be seen by building users. Contractors must balance practical installation issues with accessibility.
Commissioning and testing
Under BS 5266, emergency lighting must be tested regularly and contractors should be proactive in demonstrating how these systems support accessibility. For example, testing should confirm not just that a luminaire illuminates but that it provides adequate light levels on the escape route, including at changes of level or direction where people with mobility issues may require greater clarity.
The same principle applies to fire detection systems. Testing should ensure that visual and tactile alarms operate effectively in addition to the audible ones. Contractors who demonstrate thorough testing in line with equality considerations are providing added value and reducing liability for their clients.
Meeting the need
Maintenance plays a vital role too. A system that was compliant at installation can drift into non-compliance over time if luminaires are not replaced, signage fades or alarm devices fail. Under the Regulatory Reform (Fire Safety) Order 2005, ongoing maintenance is a legal duty. By incorporating Equality Act 2010 awareness into maintenance schedules by checking, for example, that visual alarms are still effective in bright ambient conditions or that accessible call points remain unobstructed, contractors ensure that systems continue to meet both safety and equality requirements long after initial installation.
An equally important aspect of compliance lies in documentation. The Regulatory Reform (Fire Safety) Order 2005 requires the responsible person to maintain fire safety records and BS 5266 sets out the need for logbooks and test results. Electrical contractors can assist by producing records that explicitly reference accessibility considerations. Documenting where visual alarms have been installed, noting the suitability of signage for visually impaired users, or recording that escape routes are illuminated to a standard higher than the minimum can all provide evidence of Equality Act 2010 compliance, should it ever be challenged.
Working together
Electrical contractors must liaise with architects, facilities managers and fire safety officers to integrate emergency systems seamlessly into building design. This collaboration ensures that technical standards and accessibility requirements are balanced effectively, and contractors must combine technical skill with awareness of accessibility and legal compliance.
Training and awareness are additional components of compliance. Contractors should provide guidance to clients and building staff on the proper use of fire detection and emergency lighting systems. This includes understanding alarm signals, evacuation procedures and reporting maintenance issues. Proper training reinforces both safety and equality compliance, ensuring all occupants can respond effectively in an emergency.

The relationship between the Equality Act 2010, the Regulatory Reform (Fire Safety) Order 2005, Part M of the Building Regulations, BS 5839 and BS 5266 can seem complex, but in practice it comes down to a single guiding principle and that is that life safety systems must be effective for everyone. Electrical contractors who approach compliance with that principle in mind are more likely to deliver installations that not only meet the letter of the law but also embody its spirit. In doing so, they provide peace of mind for building owners, reduce their own liability and, most importantly, contribute to safer and more inclusive environments.
